3 senior IRS officers issued chargesheets, for creating policy uncertainty & panic by unauthorisedly publishing tax hike report and misguiding younger officers
Chargesheets under Rule 14 of CCS (CCA) Rules, 1965 for violation of CCS (Conduct) Rules, 1964.

Officer divested of current responsibilities. Action taken by CBDT in view of their role and complicity in the preparation of the “tax hike” report named ‘FORCE’ which was being circulated and widely covered in media since Apr 25.

CBDT prelim inquiry concluded that the FORCE report created panic and tax policy uncertainty in the already stressed economic conditions in India. (3/4)

Chargesheets issued against:
1. Prashant Bhushan, IRS 1988 General Secretary, IRS Association. He put the report in public domain without any authority. His wife is Congress MLA from Begusarai. By doing so he violated Rule 9 & 3(1)(xx) of CCS Conduct Rules.

Prakash Dubey, IRS 200, Director DoPT, Joint Secretary, IRS Association charge sheeted for getting Junior Officers to prepare a report & unauthorisedly giving it to the IRS Association which made it public. By doing so he violated Rule 9 & 3(1)(xx) of CCS Conduct Rules. (5/6)

Sanjay Bahadur, IRS 1989 batch, also charged for getting junior officers to prepare the report & unauthorisedly giving it to IRS Association. He is Principal Director Investigation, North East Region. By doing so he violated Rule 9 and 3(1)(xx) of CCS Conduct Rules. (6/7)

All 3 officers accused of.conduct unbecoming of Central Govt servants in contravention of rule 3(1)(iii) of CCS Conduct rules.
Govt sources further said these 3 officers, despite over 30 years of service, failed to exercise due care & misguided 50 young officers.

FinMin sources pointed out that the Govt would have definitely considered the suggestions of the young IRS officers.
However, the FORCE report, instead of being sent to Govt via official channel, was made public by the 3 officers, who are of Principal Commissioner rank.

All 3 officers of the Indian Revenue Service have 15 days to respond to the inquiry ordered by the President of India under Rule 14 of Central Civil Services Rules, 1965. |
